Welcome to www.galahsp.com.au (the Website). The Website is operated by Galah Speech Pathology Pty Ltd (ABN: 16 157 487 603) (Galah Speech Pathology, we, us or our). The Website allows you to browse information about our speech pathology and allied health services, submit enquiries (including through embedded third-party forms, such as Splose referral forms), read our blog, access or sign up for free tools and resources (such as our Footy Sounds game or communication board resources), and purchase online training, workshops and digital communication resources (together, the Services).
Please read these terms and conditions (the Terms) carefully. By browsing, using or reading the Website, you confirm that you have read, understood and agree to be bound by the Terms. If you do not agree with the Terms, you must stop using the Website immediately.
Galah Speech Pathology reserves the right to review and change any of the Terms by updating this page at its sole discretion. Where changes are material, we will use reasonable endeavours to bring them to your attention (for example, by a notice on the Website). Changes take effect from the date of publication. We recommend you keep a copy of the Terms for your records.
2. Acceptance of the Terms
You accept the Terms by remaining on or using the Website. Where the option is made available, you may also accept the Terms by ticking a box or clicking to agree.
3. No therapist-client relationship
Use of the Website, including browsing, submitting an enquiry form, or purchasing online training or digital resources, does not create a therapist-client relationship and does not guarantee that Galah Speech Pathology can provide, or will provide, any particular service to you. Speech pathology and Allied Health Assistant services are provided under a separate service agreement entered into directly with you (or your parent, guardian or representative) once suitability and availability have been confirmed.
4. Privacy
Galah Speech Pathology takes your privacy seriously. Any personal, sensitive or health information provided through your use of the Website or the Services is handled in accordance with our Privacy Policy, available on the Website.
5. Intellectual property and copyright
The Website, the Services and all related content and resources are subject to copyright and are protected under the laws of Australia and applicable international treaties. Unless otherwise indicated, all rights (including copyright) in the Website and its content (including text, graphics, logos, images, video, audio, code, design elements and resources) are owned by or licensed to Galah Speech Pathology.
Subject to your compliance with these Terms, Galah Speech Pathology grants you a worldwide, non-exclusive, royalty-free, revocable licence to:
browse the Website;
copy and store the Website and its content in your device’s cache memory; and
print pages from the Website, and access purchased digital resources, for your own personal, non-commercial use.
Galah Speech Pathology does not grant you any other rights in the Website, the Services or any resources. You must not, without our prior written permission: broadcast, republish, upload to a third party, transmit, distribute, sell, resell, show or play in public, adapt or otherwise use the Website content or any purchased resources for any commercial purpose.
6. Online training, digital resources and purchases
6.1 Orders and payment. Where you purchase online training, workshops or digital resources through the Website, you must provide accurate and current payment and contact information. Prices are as displayed at checkout and are inclusive of GST where applicable. Payment is processed through our third-party payment provider(s); Galah Speech Pathology does not store full payment card details.
6.2 Access and licence. Access to online training, workshops or digital resources is personal to you and is provided for the access period, and subject to the licence conditions, stated at the time of purchase. Unless we agree otherwise in writing, you must not copy, reproduce, distribute, resell, modify, upload, share or use any purchased material for a commercial purpose.
6.3 Nature of content. Online training and digital resources are provided for general education, capacity building and professional development purposes only. They do not replace individualised assessment, therapy, medical advice, supervision or clinical decision-making for a specific person, and Galah Speech Pathology gives no assurance that any particular outcome will be achieved by using them.
6.4 Refunds and consumer guarantees. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law (or any other applicable law) that cannot lawfully be excluded, restricted or modified. Where our Services or digital resources fail to meet a consumer guarantee, you may be entitled to a repair, replacement, re-supply or refund in accordance with the Australian Consumer Law. Outside of those statutory rights, and unless stated otherwise at checkout, fees for digital resources and training are not refundable for a simple change of mind once access has been provided.
6.5 Technical requirements. You are responsible for ensuring you have a suitable device and internet connection to access online training and digital resources. Galah Speech Pathology does not guarantee that access will be uninterrupted or error-free.
6.6 Free tools, games and resources. Galah Speech Pathology may make certain tools, games or resources available free of charge, including through a website form or QR code (for example, our Footy Sounds game and communication board resources). Where you provide your name, email address, role and/or other contact details for this purpose, we will email you a link to access the relevant tool, game or resource. These items may be provided in a minimum viable product (MVP), beta or trial format, are provided for general education and informational purposes only, do not replace individualised assessment, therapy or professional advice, and are provided "as is" without warranty that they will be available, error-free or uninterrupted. Galah Speech Pathology may modify, update, suspend or discontinue any free tool, game or resource at any time without notice. Clauses 6.2 (access and licence) and 6.3 (nature of content) apply to free tools, games and resources in the same way as they apply to paid online training and digital resources.
7. General information and content disclaimer
Any information, articles, blog content, checklists, templates or other material made available on the Website is provided for general information and educational purposes only, and does not constitute individualised speech pathology, allied health, medical or clinical advice. Galah Speech Pathology recommends you seek individualised professional assessment and advice before acting, or relying, on any general information provided on the Website. Galah Speech Pathology is not liable for your use of, or reliance on, information or documents made available on the Website, within any associated blog, or within purchased digital resources, except to the extent liability cannot be excluded by law.
8. Testimonials, comments and social media interactions
If you submit a testimonial, comment, review, photo or other content to the Website or to our social media accounts (Your Content), you are solely responsible for it. By submitting Your Content, you grant Galah Speech Pathology a perpetual, irrevocable, royalty-free, transferable, sublicensable, non-exclusive licence to use, reproduce, modify and display it on the Website and our social media and promotional materials, and you confirm that:
you own or have the right to use any material included in Your Content, and are not infringing any third-party rights;
you have permission from anyone appearing or identifiable in Your Content, including, where relevant, a parent or guardian of any person under 18 featured in it; and
Your Content is not false, misleading, defamatory, offensive or unlawful.
Galah Speech Pathology may remove any content at its discretion and does not guarantee that Your Content will be archived, stored, backed up or kept accessible online.

You may be given the option to subscribe to our mailing list or newsletter, including by providing your name, email address and role. If you do, you agree to receive updates, resources and promotional material from Galah Speech Pathology in accordance with our Privacy Policy and the Spam Act 2003 (Cth). To the extent permitted by law, the total liability of Galah Speech Pathology and its officers, employees, agents and contractors arising out of or in connection with the Website, the Services or these Terms, however arising (including under contract, tort (including negligence), in equity, under statute or otherwise), is limited, at Galah Speech Pathology’s option, to the resupply of the relevant Services or the cost of resupply — except in each case for liability that cannot lawfully be limited or excluded, including liability for failing to meet a consumer guarantee under the Australian Consumer Law.
14. Indemnity
To the extent permitted by law, you agree to indemnify Galah Speech Pathology, its personnel and contractors against any loss, damage, cost or expense (including reasonable legal costs) arising out of or in connection with your breach of these Terms or your misuse of the Website, except to the extent caused by Galah Speech Pathology’s own negligence, breach of these Terms, or breach of a consumer guarantee.

If your access is terminated for breach, you are not entitled to any refund for purchased resources or Services.

17. Severance
